Compensation

Who should pay to compensate those that have been wrongly convicted and spent some time locked up in prison or elsewhere? To us this is a no - brainer. We hope that you feel the same way.

• The people directly responsible for the wrongful conviction and profited from it.
• Those that have indirect involvement yet have knowledge that the legal system is broken and did nothing, not even complain, and continue to profit from it.
•  And the law schools that trained them.
•  The bar associations that organized and supported them.

We are talking about the lawyers; they should stand up and do what’s right, but that is not going to happen voluntarily. They would rather not compensate at all, or have the money come from us, paid out of the general fund, the money that should be used for educating are kids, space exploration, firefighting, etc.

We at lawyersout.com are committed to right this wrong. The federal government, Congress could force a fee or tax on all that have passed the bar, and are practicing law to pay the wrongly convicted out of the lawyers own pocket. There are approximately 1,143,358 million lawyers in the U.S.A.  If each lawyer was charged just $20 a month not a lot for someone that charges $300 per hour, that would raise $22,867,160 million every month or $274,405,920 million per year. If you have read any of the profiles from The Innocence Project you can see that some have been compensated and some have not. The money that is raised by are method should be divided to reimburse the states that have already paid on their own. And compensate the wrongly convicted that haven’t got a dime as yet. We have no idea how much is adequate compensation and will leave this to someone else to decide. Look at how the different states handle Compensation and see if you think this is right. Compensation by States and More States pages . You can see that the states are not all equal. We think the compensation should be handled at the federal level, since the people that were wrongly convicted had their constitutional rights violated. Look at the 5th and 14th Amendments to the United States Constitution. These address this issue.

It should be noted that there will be more wrongly convicted found and they will have to be paid as well. This brings us to who should pay for the Search for Innocence?
